Terms and Conditions for PTM: Pakistan Trade Mart

1. Acceptance of Terms

Welcome to PTM: Pakistan Trade Mart (“Platform”, “we”, “us”, “our”). By accessing or using our website at https://ptmofficial.com, mobile application, or services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use our Services.

2. Definitions

  • “Platform” refers to PTM: Pakistan Trade Mart, including website and mobile application.
  • “Customer” or “Buyer” means any person who purchases products through the Platform.
  • “Vendor” or “Seller” means any person or entity registered to sell products through the Platform.
  • “User” means any person accessing the Platform, including Customers and Vendors.
  • “Content” includes product listings, descriptions, images, reviews, comments, and any other material posted on the Platform.

3. Account Registration and Security

3.1 Eligibility

  • You must be at least 18 years old to use our Services.
  • You must have legal capacity to enter into binding contracts.
  • Vendors must provide valid Computerized National Identity Card (CNIC) and business registration where applicable under Pakistani law.

3.2 Account Creation

  • You must provide accurate, complete, and current information as per requirements of Pakistani law.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are solely responsible for all activities under your account.
  • You must immediately notify us of any unauthorized use of your account.

3.3 Account Suspension/Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Provide false information
  • Engage in fraudulent activities
  • Harm other users or the Platform
  • Violate any laws of Pakistan

4. Platform Role and Limitations

4.1 Our Role

PTM: Pakistan Trade Mart is a facilitator and technology service provider under Pakistani e-commerce regulations. We:

  • Provide a platform for Vendors to list products
  • Enable Customers to discover and purchase products
  • Process payments through secure gateways approved by State Bank of Pakistan
  • Provide communication tools between Users

4.2 What We Are NOT

We are NOT:

  • A party to transactions between Customers and Vendors
  • A seller or reseller of products listed on the Platform
  • Responsible for product quality, authenticity, or legality under Pakistani Consumer Protection laws
  • Liable for delivery times or shipping damages
  • Responsible for Vendor after-sales service

5. Vendor Terms

5.1 Vendor Eligibility

  • Must provide valid CNIC and business documentation as per Pakistani requirements
  • Must comply with all applicable Pakistani laws including Sales Tax Act 1990
  • Must maintain accurate business information with Pakistan’s relevant authorities
  • Must have valid bank account in Pakistan for receiving payments

5.2 Product Listings

  • Vendors are solely responsible for their product listings
  • Products must be accurately described with clear images
  • Prohibited items include but are not limited to:
  • Counterfeit or pirated goods (violating Intellectual Property Organization of Pakistan)
  • Illegal substances under Pakistan’s Control of Narcotic Substances Act 1997
  • Weapons without proper licenses under Pakistan Arms Ordinance 1965
  • Items violating Islamic principles or Pakistani cultural norms
  • Products violating Pakistan’s Import and Export laws
  • Live animals without proper permits

5.3 Pricing and Payments

  • Vendors set their own prices in Pakistani Rupees (PKR)
  • Platform commission will be clearly stated during registration (typically 5-15% per transaction)
  • Payments to Vendors are processed after order completion, minus platform fees
  • Minimum withdrawal amount: PKR 2,000 (two thousand Pakistani Rupees)

5.4 Vendor Responsibilities

  • Must fulfill orders promptly and accurately
  • Must provide clear return and refund policies
  • Must maintain adequate stock levels
  • Must handle customer inquiries professionally
  • Must package products securely for shipping within Pakistan
  • Must comply with all FBR tax obligations

6. Customer Terms

6.1 Purchasing Process

  • Orders are offers to purchase from Vendors
  • Vendors may accept or reject orders at their discretion
  • Payment must be completed before order processing
  • Customers may cancel orders before shipment, subject to Vendor’s policy

6.2 Payment Methods

We accept payment methods approved by State Bank of Pakistan:

  • JazzCash (PSO/PSP licensed by SBP)
  • Easypaisa (PSO/PSP licensed by SBP)
  • Credit/Debit Cards (Visa, MasterCard, etc.) through SBP-approved gateways
  • Bank transfers through Pakistani banks

6.3 Pricing and Taxes

  • Prices are set by Vendors in Pakistani Rupees (PKR)
  • Prices include applicable Sales Tax where specified
  • Shipping costs are additional unless stated otherwise
  • Prices may change without notice

7. Transactions and Disputes

7.1 Order Confirmation

  • Order confirmation emails are acknowledgments, not acceptance
  • Vendors must confirm acceptance within 24 hours
  • Unconfirmed orders may be automatically cancelled

7.2 Dispute Resolution Process under Pakistani Law

Step 1: Customer contacts Vendor directly to resolve issue
Step 2: If unresolved within 7 days, Customer opens dispute through Platform
Step 3: Platform mediates and reviews evidence from both parties
Step 4: Platform makes binding decision based on Pakistan’s Consumer Protection laws

7.3 Our Decision is Final

  • PTM’s decision in disputes is binding on all parties
  • We may withhold funds during investigation as per Pakistan’s e-commerce guidelines
  • Decisions are based on Platform policies and available evidence

8. Refunds and Returns

8.1 General Policy

  • Return policies are set by individual Vendors but must comply with Pakistan’s Consumer Protection Act
  • Customers must review Vendor’s return policy before purchasing
  • Refunds are processed to original payment method within Pakistani banking timelines

8.2 Eligible Returns

Products may be returned if:

  • Incorrect item received
  • Item damaged during shipping
  • Item significantly not as described
  • Within Vendor’s specified return period (minimum 7 days as per Pakistani norms)

8.3 Non-Returnable Items

  • Perishable goods
  • Customized/personalized items
  • Digital products
  • Intimate/sanitary products
  • Items specified as non-returnable by Vendor

8.4 Refund Timeline

  • Refunds processed within 7-14 working days as per Pakistani banking practices
  • Bank/payment processor delays may apply
  • Platform fees are non-refundable

9. Shipping and Delivery

9.1 Shipping Responsibility

  • Vendors are responsible for shipping arrangements through Pakistan Post or private couriers
  • Shipping costs and timelines are Vendor’s responsibility
  • International shipping must comply with Pakistan Customs regulations

9.2 Delivery Issues

  • Lost/damaged shipments should be reported within 3 days of expected delivery
  • Claims must be filed with shipping carrier by Vendor
  • Platform is not liable for shipping delays or damages

10. Intellectual Property

10.1 Platform Content

All Platform content (excluding Vendor content) is owned by PTM:

  • Logos, trademarks registered with Intellectual Property Organization Pakistan
  • Website design and code
  • Platform features and functionality

10.2 User Content

  • Vendors retain ownership of their product listings and images
  • By posting content, you grant PTM license to display it on the Platform
  • You are responsible for ensuring you have rights to all posted content under Pakistani IP laws

10.3 Prohibited Actions

You may not:

  • Copy, modify, or distribute Platform content without permission
  • Use PTM trademarks without authorization
  • Post content infringing others’ intellectual property rights registered in Pakistan

11. Prohibited Conduct

11.1 General Prohibitions

Users may not:

  • Engage in fraudulent activities under Pakistan Penal Code
  • Misrepresent products or services
  • Harass or threaten other users
  • Post false or misleading reviews
  • Circumvent Platform fees or policies
  • Use Platform for illegal purposes under Pakistani law

11.2 Specific Vendor Prohibitions

Vendors may not:

  • List prohibited items as per Pakistani law
  • Engage in price manipulation
  • Falsify reviews or ratings
  • Attempt direct transactions outside Platform to avoid commissions
  • Violate Platform commission structure

12. Limitation of Liability

12.1 General Limitation

To the maximum extent permitted by Pakistani law:

  • PTM’s total liability shall not exceed transaction amount
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for third-party actions or omissions

12.2 Specific Exclusions

We are not liable for:

  • Product quality or authenticity
  • Shipping delays or damages
  • Vendor business practices
  • Incorrect product information
  • Financial losses from Platform use
  • Technical issues beyond our control

13. Indemnification

You agree to indemnify and hold harmless PTM: Pakistan Trade Mart, its owners, employees, and affiliates from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your infringement of others’ rights under Pakistani law
  • Any claims arising from your products or services

14. Fees and Payments

14.1 Platform Fees

  • Vendors pay commission on each sale (5-15% as specified during registration)
  • Commission rates may change with 30 days notice
  • Additional fees may apply for premium services

14.2 Payment Processing

  • Payment processing fees are deducted from transactions (2-3% typically)
  • All transactions in Pakistani Rupees (PKR)
  • Minimum withdrawal amount: PKR 2,000 for Vendors

14.3 Tax Responsibility

  • Vendors are responsible for collecting and remitting Sales Tax to FBR
  • Platform may report earnings to FBR as required by Pakistani law
  • Customers may be charged applicable taxes as per Vendor’s registration status

15. Privacy

Your privacy is protected under Pakistan’s upcoming Personal Data Protection Act. Our Privacy Policy governs data collection and use. By using our Services, you consent to our Privacy Policy.

16. Termination

16.1 By User

You may terminate your account at any time by:

  • Contacting customer support
  • Following account closure procedures
  • Settling all outstanding obligations under Pakistani law

16.2 By PTM

We may terminate or suspend your account:

  • For violation of these Terms
  • For fraudulent activity under Pakistan Penal Code
  • By providing 30 days notice for business reasons
  • Immediately for severe violations of Pakistani law

17. Modifications to Terms

We may modify these Terms at any time:

  • Changes will be posted on the Platform
  • Continued use constitutes acceptance
  • Material changes will be notified via email 30 days in advance

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

18.2 Dispute Resolution

  • First: Attempt informal resolution through customer support within Pakistan
  • Second: Mediation in accordance with Pakistan’s Alternative Dispute Resolution Act 2017
  • Third: Arbitration in Lahore, Pakistan as final resolution
  • Court proceedings in civil courts of Pakistan only where arbitration not feasible

18.3 Jurisdiction

Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Lahore, Pakistan.

19. Force Majeure

We are not liable for delays or failures due to:

  • Natural disasters
  • Government actions including PEMRA regulations
  • Internet outages by Pakistani ISPs
  • War or terrorism
  • Other events beyond our control recognized under Pakistani Contract Act 1872

20. Severability

If any provision of these Terms is found invalid or unenforceable under Pakistani law, the remaining provisions remain in full effect.

21. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PTM: Pakistan Trade Mart regarding Platform use.
